The original Red Creek Ranch Property Owners Association, Inc., (RCRPOA) was created in 1994 under the Colorado Common Interest Ownership Act (CCIOA) as a type of subdivision known as a Common Interest Community. The current Act, as amended, may be found at : Articles of Incorporation-11.23.2004
RCRPOA was incorporated as Non Profit Corpration and run by the Declarant, Joe O'Brien, of Red Creek Ranch, Inc.:

The
original Declaration of Covenants, Conditions, Restrictions and Easements
for Red Creek Ranch was dated May 23, 1994. It was amended numerous
times by the Declarant, who also made many additions and revisions to the
plats of the subdivision which are recorded in the records of the Pueblo
County Clerk and Recorder. These plats define the Lots which
make up the subdivision.
In 1999, Joe O'Brien had sold the required 75% of lots and passed
governance of the RCRPOA to a duly elected Board of
Directors. In 2004, a majority of property owners voted to split Red Creek Ranch into 3 separate associations: RCR-Newton, RCR-Roper, and RCR-Exempts (properties with access directly to public roads, exempt from dues but not from the declaration covenants ). This split was accomplished by court order dated November 23, 2004.

Our governing body, RCR-Newton Property Owners Association, was incorporated as a Colorado Nonprofit Corporation on 08-12- 2004. Articles of Incorporation-11.23.2004 It is governed by the following Bylaws. Corporate Bylaws-08-12-2004
As a result of the 2004 split, the original Declaration of 1994 was superceded by the Declaration of Covenants, Conditions, Restrictions and Easements for Red Creek Ranch Phase V.
